When a marriage ends and parties live apart, the time that each parenting will have with the children will generally be less than what it was before. A child is entitled by law to spend valuable time with each divorced parent individually but this does not always mean equal.
Parenting time, also known as visitation, is designed to foster a strong healthy relationship between the children and the parents. Most courts follows a default visitation schedule, established by the Friend of the Court offices.
The standard parenting time varies from county to county in Michigan. For many counties the standard is for the non-custodial parent to receive every other weekend from Friday afternoon/evening to Sunday afternoon/evening and one non-overnight visit per week during the week.
of the Children
There are many different parenting time situations and schedules that may be the best for you and in the best interest of the children. The attorneys as Gordon & Hess, PLC work with mothers and fathers to structure visitation agreements that work for all those involved. If you and your ex-spouse are able to agree on an appropriate and flexible visitation schedule, the court will most likely approve the agreement. Many time this can be accomplished through mediation if both parties are willing to be fair and compromise.
If an agreement cannot be reached, we will help you present your evidence to the court in the best light and to fight for the results you seek. When both spouses cannot agree on terms for parenting time and visitation for a child, the court is ultimately forced to make the decisions for you and your family. The parenting time order that is issued will be based upon a consideration of the “best interest factors” and will declare exactly when the children must spend time with the each parent.
